1. Scope
These terms apply whenever you provide payment information to State Entity Recovery Group LLC (‘SERG’) for the purpose of resolving, reducing, or servicing a placed account. Nothing in these terms creates an obligation to pay an amount that is not properly owed. Your rights under the FDCPA, Regulation F, and applicable state law are not affected by these terms.
2. Accepted payment methods
Depending on the account, we may accept payment by:
- Debit card.
- Credit card, where permitted for the account type.
- Automated clearing house (ACH) transfer from a U.S. bank account.
- Check or money order sent by mail.
We do not accept cash, cryptocurrency, gift cards, or wire transfers. Any request that asks you to pay by an unusual method — such as gift cards or cryptocurrency — is not coming from SERG.
4. One-time payments
A one-time payment is charged in a single amount on the date you authorize (or the next business day if the authorized date is not a business day). Once submitted for processing, a one-time payment cannot be reversed by SERG; you may pursue the reversal rights described in Sections 9 and 13.
5. Scheduled and recurring payments
You may schedule a series of payments on future dates, or set up a recurring payment on a fixed cadence. Each scheduled payment is initiated on its scheduled date. Recurring authorizations remain in effect until the balance is resolved or until you cancel the authorization as described in Section 10.
6. Post-dated payments
We do not deposit or process a post-dated payment before its date. We do not solicit a post-dated payment for the purpose of threatening or instituting criminal prosecution. These practices are prohibited by the FDCPA and by our internal policies.
7. Payment processor
Payments are processed through a third-party payment processor that specializes in collections and receivables. The processor is contractually required to maintain PCI DSS compliance and to use appropriate technical safeguards. Card and bank information you enter is captured directly by the processor's systems.
8. Receipts and confirmations
You will receive a receipt for each processed payment. Receipts include the amount, date, payment method identifier, account reference, and a confirmation number. Please retain receipts for your records.
9. Returned or reversed payments
If a payment is returned unpaid (for example, because of insufficient funds, a closed account, or an incorrect account number), we will notify you and, where permitted, may attempt to re-present the payment. If the return results in a fee from your bank or card issuer, you are responsible for that fee. We do not add returned-item fees to your account balance unless clearly authorized by the account documentation and by applicable state law.
10. Cancellations and modifications
You may cancel or modify a scheduled or recurring payment at any time before it is submitted for processing. Cancellations submitted at least [PENDING CUT-OFF] before the scheduled processing time will be honored for that date; cancellations submitted after the cut-off will apply to the next scheduled payment. You can request a cancellation by calling [PHONE], writing to the mailing address on your validation notice, or replying to your most recent payment confirmation.
11. Refunds
If a payment is processed in error, in an incorrect amount, or on the wrong account, please notify us as soon as possible. We will investigate and, where the payment was in fact made in error, promptly issue a refund to the original payment method. Refund timing is subject to the processing timelines of the payment processor and the card issuer or bank.
12. Settlement offers
A settlement offer, if extended, will describe in writing the amount, the payment schedule, and the effect on the account if fully performed. A settlement offer is valid only for the terms and time stated in the offer. Partial performance of a settlement does not, by itself, resolve the account.
13. Payment disputes
If you believe a charge is unauthorized or incorrect, please contact us at [PHONE] or through our Complaints and Feedback page. You also have the right to contact your card issuer or bank to dispute the transaction directly. Nothing in these terms limits your rights under 15 U.S.C. § 1666i (Fair Credit Billing Act) or under Regulation E (Electronic Fund Transfer Act).
